Consultations Underway on Armed Forces Law – Khawaja Asif ka Bayan

Islamabad: Defence Minister Khawaja Asif ne kaha ke hukoomat Pakistan ke armed forces law main tabdeeli laane par kaam kar rahi hai. Yeh process mutual consultation ke zariye ho raha hai. Unka kehna tha ke Article 243 main amendments par mashwaray jari hain. Yeh process tamam political parties ke saath mil kar kiya ja raha hai.

Article 243 ka Background

Pakistan ke Constitution ka Article 243 kehta hai ke “Federal Government shall have control and command of the Armed Forces”. Is ke mutabiq “the Supreme Command of the Armed Forces shall vest in the President”.
Yani Armed Forces ka control federal hukoomat ke paas hota hai, jabke supreme command President ke paas hoti hai.

Ab hukoomat is article main kuch constitutional changes par ghoor kar rahi hai. Maqsad yeh hai ke defence structure ko behtar banaya jaye aur use modern zaruriyat ke mutabiq update kiya jaye.

Geo News ke exclusive interview main Khawaja Asif ne kaha:

“Consultations on amending Article 243 are ongoing, defence requirements have changed. Yeh tamam process mutual consultation ke zariye kiya ja raha hai.”

Unka kehna tha ke hukoomat ka irada hai ke armed forces law ko waqt ke taqazon ke mutabiq modern banaya jaye. PML-N ki current government is dafa dusri baar apne tenure main constitutional amendment ka soch rahi hai.

Mashwaray Sab Political Parties Ke Sath

Defence minister ne kaha ke consultations sab political parties ke saath ho rahe hain. Hukoomat chahti hai ke amendment par consensus ho taake opposition aur allies dono ka trust hasil ho.

Jab unse amendment ke details puchi gayi to unhone kaha:

“Main is waqt kuch nahi keh sakta jab tak Article 243 ka amendment final nahi hota.”

Reliable sources ke mutabiq, Prime Minister Shehbaz Sharif ne National Assembly Speaker Ayaz Sadiq ko hidayat di hai ke wo tamam political parties se consensus hasil karein taake amendment smoothly pass ho sake.

Yeh bhi bataya ja raha hai ke PML-N ne is silsile main PPP Chairman Bilawal Bhutto-Zardari se bhi support maangi hai. 03 November ko Bilawal Bhutto ne tasdeeq ki ke ruling party ne proposed amendment ke liye PPP ka support talaba kiya hai, aur is par dono parties ke darmiyan guftagu bhi jari hai

Bilawal Bhutto Ka Reaction

Bilawal Bhutto ne kaha ke proposed amendment sirf Article 243 tak mehdood nahi, balkay is main ek Constitutional Court banane aur National Finance Commission (NFC) Award main kuch tabdeeliyan karne ki baat bhi shamil hai.

Is ka matlab hai ke hukoomat aik comprehensive constitutional reform package par kaam kar rahi hai jo sirf armed forces law nahi balkay judiciary aur financial distribution systems ko bhi affect karega.

Ishaq Dar Ka Reaction

Agle din Deputy Prime Minister aur Foreign Minister Ishaq Dar ne kaha ke hukoomat ne sirf PPP hi nahi balkay dusri political parties — jaise MQM-Pakistan, ANP, aur Balochistan Awami Party — ko bhi onboard lene ka faisla kiya hai.

Unka kehna tha ke hukoomat chah rahi hai ke amendment ko broad-based consensus ke saath parliament main pesh kiya jaye taake national unity ka paigham diya ja sake.

Constitutional Court Ka Iqdam

Defence Minister Khawaja Asif ne yeh bhi bataya ke amendment proposals main aik separate Constitutional Court banane ka plan shamil hai jisme har province se representation hogi.

“Constitutional cases mushkil aur complex hote hain, unka ratio sirf 6% hai lekin unke nature ki wajah se time zyada lagta hai. Isliye alag bench ya court banana zaruri hai.”

Unka kehna tha ke abhi jo judges daily cases sunte hain, wahi constitutional matters bhi dekhte hain, jis se workload barhta hai. Naye bench formation aur Constitutional Court ke zariye judicial efficiency badhayi ja sakti hai.

“Court Without a Court” Tanqeed

Asif ne kaha ke kuch logon ne existing Constitutional benches par tanqeed ki hai aur unhe “court without a court” kaha hai.

27th Amendment Ka Aim

Proposed 27th Amendment ka primary aim hai ke Pakistan ke Armed Forces Law aur constitutional control ke structure ko modern era ke mutabiq banaya jaye.
Is amendment ke zariye:

• Armed forces ke command aur control system main clarity lani hai.
• Civil-military coordination ko mazboot banana hai.
• Constitutional Court establish karna hai taake legal complexities kam hoon.
• Provinces ko constitutional matters main equal say mil sake.
• Judiciary ke workload ko balance karna hai.

Political Consensus Zaroori

Political analysts ke mutabiq, agar hukoomat yeh amendment consensus-based pass karwati hai to yeh ek major constitutional reform hoga.
Magar agar opposition ne is par reservation dikhayi, to yeh issue controversy ka shikar bhi ho sakta hai.

Experts ka kehna hai ke Constitution main tabdeeli ka process hamesha delicate hota hai aur is ke liye political maturity aur trust building zaruri hoti hai.
